Rights and responsibilities come from custom and convention. Convention says that individuals are obliged to or compelled to do certain things. The actions of individuals under convention serve to ensure that society maintains civility. The everyday look is what this is. That is his custom.
For purposes of these photos, it portrays an art and just as any painting, it used what was available to capture the eye of the beholder, thus, it was manufactured and created resulting in the final product, the photographs.
